Reporting copyright violations under DMCA

Article Summary

InVision is committed to protecting the intellectual property rights of others and has adopted a policy for handling alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If you discover content hosted on the InVision platform that infringes a copyright you own or control, please submit a Notice of Claimed Infringement pursuant to our policy found below:

  1. Prepare a notice of copyright infringement containing the following required information:
    • Identification of works or materials being infringed
    • Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence
    • Contact information for the notifier including address, telephone number and, if available, email address
    • A statement that the notifier has a good faith belief that the material is not authorized by the copyright owner, its agent, or the law
    • A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner
    • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed

  3. Sometimes, we might have a question about your notice. In this case, we might respond to your notice and ask for more information. When we remove content in response to a notice of copyright infringement, we notify the person you reported to inform them the content was removed. We may also provide them with your contact information, including your email address and the name of your organization or client, and/or the contents of your notice.

  4. If you misrepresent that material is infringing, you may be liable for damages (including costs and attorneys' fees). Therefore, if you are not sure whether the material is infringing, please contact an attorney before submitting a notice to InVision. Fraudulent or abusive notices or other misuse of the DMCA process, or repeated infringement of third-party copyrights, may result in account termination or other legal consequences.

  5. If the person who posted the content believes that the content shouldn’t have been removed, they may reach out to you directly to try to resolve the issue. If the content was removed under the notice and counter-notice procedures of the DMCA, they may also be able to submit a counter-notification under the DMCA.

  1. If you believe that a notice of copyright infringement was mistakenly issued you may submit a counter-notice asserting your rights to the content in question. To do so, you must reply to the notification you received from InVision with a counter-notice containing the following details:

    • Your physical or electronic signature or that of a person authorized to act on your behalf
    • Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed
    • Contact information for you or an agent authorized to act on your behalf including address, telephone number and, if available, email address
    • A statement confirming that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside of the United States, for any judicial district in which InVisionApp, Inc. may be found and that you will accept service of process from the person who submitted a notice of alleged infringement in compliance with subsection (c)(1)(C) of the DMCA 
    • A statement made under penalty of perjury that you have a good faith belief that the allegedly infringing content was removed or restricted due to a mistake or misidentification of the content to be removed
  2. Once you submit your counter-notice it may be forwarded to the party who originally submitted a notice of alleged infringement. Please see the preceding section “How do I report a violation of my copyright?” for more information on the process once you submit a counter-notice.
